Your contract for purchases made through the Site is with hmfurniture.co.uk and you undertake that any and all goods ordered by you are for your own private and domestic use only.

Contracts formed between hmfurniture.co.uk and you as a result of using this site shall be governed in all respects by English law and you hereby submit to the non-exclusive jurisdiction of the English courts.

You must be 18 years old to use this site. If you are under eighteen, you may only use the site in conjunction with, and under the supervision of, a parent or guardian. If you do not qualify, please do not use the site.

While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

No contract for the sale of any product will subsist between you and hmfurniture.co.uk until hmfurniture.co.uk dispatches the product(s) ordered. We will confirm that the product(s) have been dispatched by a confirmation email. This confirmation e-mail amounts to an acceptance by hmfurniture.co.uk of your offer to buy goods from hmfurniture.co.uk or a third party supplier that is engaged on your behalf by hmfurniture.co.uk (whether or not you receive that e-mail).

You agree that e-mail can be used as a long-distance means of communication.

This confirmatory e-mail will contain all relevant statutory information concerning your contract.

The confirmatory e-mail will also contain a link to these terms and conditions, and may be amended in accordance with paragraph 35 below from time to time.

You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.

Hmfurniture.co.uk will not pass on your personal or credit or debit card details to any third party except where an additional security check may be deemed necessary. We shall be entitled to process your data in accordance with the terms of HM Furniture Privacy Policy. Please view this document for further information.

You undertake that all details you provide to hmfurniture.co.uk for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.

You must choose a username and password on completion of registration. You are responsible for all actions taken under that username and password and shall only use the Site under your own username and password. You must make every effort to keep your password safe and should not disclose it to anyone. If it is compromised, you must change it. You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password.

You may cancel your order at any time prior to your order being processed by clicking on the ‘cancel’ link next to the product ordered on your account page on the website. You may also withdraw from the contract at any time after the product has been paid and you have received our email confirming your order but no later than 7 working days from the time of your payment by:

sending the notice of cancellation by email to cancellation@hmfurniture.co.uk ensuring that you quote your name, address and order reference number; or

where you have already received the goods, returning the goods to hmfurniture.co.uk unopened together with the original invoice. Hmfurniture.co.uk will refund you the purchase price of the goods. Where appropriate hmfurniture.co.uk shall refund any additional customs duties borne by you on receipt of the relevant customs receipt.

Once hmfurniture.co.uk receive notification from you that you wish to withdraw from the contract (in accordance with these terms), any sum debited to hmfurniture.co.uk from your credit card in relation to your order will be re-credited to that credit card account as soon as possible and in any event within 30 days of your order provided that the goods you wish to return are received by hmfurniture.co.uk in the condition that they were in when delivered to you. You will be liable for any charges incurred in returning the goods to hmfurniture.co.uk

Hmfurniture.co.uk reserves the right to make a 20% restocking charge for any goods which are not returned in mint condition or to refuse to accept such goods, at its sole discretion. Hmfurniture.co.uk also reserves the right to make a charge for collecting goods from your premises in circumstances where they are not defective but you have cancelled your order. Your statutory rights are not affected. 

Processing of orders

Credit and Debit cards are debited on the day of order by hmfurniture.co.uk. All prices include VAT (where applicable) unless otherwise stated.

Delivery and risk 

The period stated within which you will receive your order is approximate. Goods will be sent to the address given by you in your order and stated in the Order Confirmation. Please note that your goods may be sent to you in instalments. You may cancel your entire order with us if subsequent instalments forming part of your order are not delivered by us. We do not ship outside UK. 

Miscellaneous 

We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.

We shall have no liability (including liability for negligence) for the acts or omissions of telecommunications service providers or for failures of, or faults in their networks and equipment.

No waiver by us of any breach of these HM Furniture Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.

You may not permit; create unauthorised framing of, or deep linking to, the Site or the creation of derivative works thereof from any other website under your management or control.

In these HM Furniture Terms, ‘Intellectual Property Rights’ means patents, database rights, copyright, design rights (whether registered or unregistered), trade marks (whether registered or unregistered) and other similar rights, together with the right to apply for the protection of any such rights. All Intellectual Property Rights in the Site shall be owned by us absolutely.

Subject to the licence granted to you to use the Site, in accordance with the terms of hmfurniture.co.uk reserves all rights, title and interest in its Intellectual Property Rights in the Site. Any goodwill accruing from use of hmfurniture.co.uk and its affiliates’ trade marks, trade and business names and service marks under this Agreement will vest in hmfurniture.co.uk and its affiliates, as appropriate.

It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. Hmfurniture.co.uk tracks the electronic ‘fingerprints’ of every order placed on hmfurniture.co.uk to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website.

We reserve the right to terminate this Agreement and to suspend or terminate your access to the Site immediately and without notice to you if:

you fail to make any payment to us when due;

you breach the terms of this Agreement (repeatedly or otherwise);

when requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity;

Prices

The prices quoted are those ruling at the time of production. Due to circumstances beyond our control, prices may have to be altered up or down, including any alterations to the rate of value added tax. The correct price will be shown on your delivery note. All prices shown are cash prices in sterling. We reserve the right to alter or amend the credit charges, to withdraw credit, to accept or reject orders, to request part payment, to refuse applications or with prior written notice to close an account.

Shipping Zones 

We currently deliver to mainland UK addresses and Northern Ireland only. Please note there are different delivery charges in some UK Mainland, Scotland and Northern Ireland areas that begin with the following letters: 

SA, PL, TQ: £129 

AB, DD, PH, TR: £139 

BT: £139 - may add a further 1-2 weeks to your estimated lead time. 

For postcodes begins with following letters: KW, IV, and PA please email us or call us for quotation. 

All differences in delivery charges to above postcodes need to be paid via PayPal. Within 24h we will send you on your PayPal account an invoice for outstanding amount to pay as soon as posible. 

For Post Codes other then listed above requiring shipment outside of the UK Mainland, orders will not be processed. We will contact you to confirm cancellation of order and will refund your money.

Payment

You can pay by; Visa, MasterCard, Electron, Delta, Switch, Solo cards or your existing PayPal account. To ensure that shopping on-line is secure, your credit/debit details will be encrypted using SSL technology. The prices displayed on are web site are in £GBP British pound Sterling.

Making a purchase couldn’t be easier.

1. Click on the item(s) you wish to buy and then place them into your basket.

2. After you have made your selections, you will be asked for the details of both yourself and the recipient.

3. Once these details are submitted you will be asked to choose one of the delivery options and to then proceed with    your payment.

4. You will be directed to a secure on-line Pay Pal payments site.

5. There are two methods of payment on the Pay Pal site:

    a) Using your Debit or Credit Card.
    b) Using your existing Pay Pal account. 
 
6. Choose your preferred method of payment and follow the steps shown. 

7. Review your payment (check price and details are correct).

8. If you are happy with the above proceed with your payment.

9. Finally you will be sent an email to confirm receipt of your order.

Delivery 

You will normally receive your sofa around 2-5 weeks after we have received your payment (please see individual product pages for delivery details or Post Codes availability). However, during busy periods, or deliveries to rural and distant areas may take a little longer. Please ensure your shipping address and mobile number is correct, as we take no responsibility for undeliverable orders due to incorrect addresses or contact numbers. You can check that we have your correct personal details by going onto www.hmfurniture.co.uk and sign in via “My Account” select “your address book” this will show your current details. 

As soon as your item’s ready we will contact you with a date of delivery. If you can not accept the first option then you will be offered other alternatives. 

Your order will be delivered by a professional Courier Company. Delivery days are Monday to Sunday between 8am and 10pm. Delivery is not available on public holidays. These orders will be delivered on the next working day. Please note, we can not guarantee delivery times but the courier will inform you if the expected delivery time changes.

On Delivery 

On the day of delivery the Courier Team will unpack your furniture, install it in the room of your choice (on the ground floor only) and remove all packing materials from your home and recycle wherever possible. To make sure you are completely satisfied with your furniture the Courier Team will ask you to sign for your furniture after it has been installed. Two man premium delivery does not apply to Northern Ireland Post Codes. 

Please ensure all access points are clear of obstacles. If there are steps leading to your flat or apartment an additional handling fee will apply. The fee is £10 per floor to a maximum of £30. This should be paid to the driver at the point of delivery. 

Please note we do not accept responsibility if the furniture ordered will not fit through doorways or becomes stuck in narrow areas within your property. It is the customer’s responsibility to measure all spaces before placing an order. 

Northern Ireland Delivery: 1 man can assist to place the furniture in to the entrance of the property at entirely the customers responsibility.

Cancellation 

All our Products are made to your specification and are not sold from stock unless clearly identified as "stock furniture". As a sofa is made-to-order and produced precisely to your requirements, no cancellation, refunds or exchanges can be made unless your instructions have not been carried out, or the item is found to be faulty. 

A non-refundable deposit of 15% per stock furniture order will be payable if the order is cancelled after 7 days. This charge will be made to your account. Your statutory rights are not affected. 

Returns 

For your peace of mind and in compliance with the distance selling law, we offer a 7 days money back guarantee within which, for what ever reason, you may return your item for a full refund (excluding P&P costs). If within 7 days will inform us that you have changed your mind and want to return item, we will not refund delivery fee. We will refund whole amount you paid for item purchased but we will charge you with delivery charge. Please note that the item must be returned to us in the condition that it was sent out in along with the correct packaging, so that we can sell it again. If an item is not returned to us in the original condition then we reserve the right not to issue a full refund. Our 7 days money back guarantee dose not apply to sofas ordered to your specification. 

Returned items which are not in new or unused condition, or which are returned after 7 days period may not be credited to your account unless they are faulty. 

A non-refundable collection charge will be applied to selected furniture items if delivery is refused, or collection is requested, unless the product is faulty or does not fit the description given. 

No refunds or exchanges can be given on sofas made to your specification, unless there is a manufacturing defect or the goods are not as ordered. No refunds or exchanges can be given on either sample pots or full size pots of paint unless there is a manufacturing defect, or the goods are not as ordered. 

Returns - Non Faulty Goods 

If you wish to return your order of stock furniture products within 7 working days time period, you are entitled to do so, but must return the products to us in accordance with our instructions and at your own cost. 

If for any reason you need to return an item within 7 working days of receiving delivery, please call the customer help line and advise a member of our team that you wish to return the product and the reason for return. Please note that the item must be returned to us in the condition that it was sent out in along with the correct packaging, so that we can sell it again. If an item is not returned to us in the original condition then we reserve the right not to issue a full refund.

Under the terms of the distance selling directive you as the customer have a duty of care for the product whilst it is in your possession. If products are damaged by you and subsequently returned, a charge will be made to repair the product to its original condition. Please be aware that where repair is not economically viable no refund will be made. Your legal rights are not affected. 

Returns - Faulty Goods

Notwithstanding our Delivery condition above If, after the goods have been fitted, you find a fault; we reserve the right to request that the following steps are complied with:

• you provide written notice of the defect to us and/or telephone us quoting your order reference number within 7 days of discovering the defect ; and
• you allow us to provide an engineer, you will be contacted to arrange a house visit to inspect the goods and confirm the fault or if asked by us we will arrange for the goods to be collected from you and returned at the our expense for the examination to take place there.

Upon confirmation from the engineer that there is fault, and the goods do not conform to the contract, we shall at our option repair or replace such goods (or the defective part) or refund the price of such goods, whichever is considered to be economically viable by us.

HM Furniture shall not be liable for the goods if you continue to use the goods after giving such notice to us; or alter or repair the goods without the written consent of us.

To resolve your problem with regard to Faulty products please contact one of our helpful and friendly customer service team who will be happy to resolve your problem as quickly and efficiently as possible with the minimum disruption possible.

Refunds 

Refunds will be made within 30 days of notification, via the same method that was whichever method was originally used for the transaction. 

Warranties 

Our range of sofas online includes a one year warranty against any manufacturing defect to upholstery, springs and framework. The warranty starts from the date of delivery. 

Product warranties does not apply to Northern Ireland orders, unless the item will be posted to our warehouse in Manchester (in that case return/delivery cost must be covered by customer).

Measure right before you buy 

You must measure your doors and hallways to make sure item fits in the passages. 
Measure your living room space ensuring that sofa fits well into the available space and also if applicable has enough space left to be extended. 
All dimensions are listed with each item to help you choose the best for your room. 

Colours, shapes and sizes 

The colour of goods may vary slightly from that shown on the website due to limitations of browser software and monitors.

Also colour variations are likely to occur due to the nature of natural raw materials used.

Irregular shaped plaques may vary slightly from the samples shown. All measurements are metric. 

Terms And Conditions Of Sale

You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for them.

We reserve the right to charge any delivery costs from the customer, if an item is returned to us due to failed delivery after delivery arrangements have been communicated to you.

We will not refund goods that are delayed in transit due to any reason, including industrial action by third parties.

If the goods we deliver are damaged or defective you must phone us on with full details of the problem, within 7 working days of the delivery of the goods in question.
